Gig-Economy Worker Benefits Will Affect ACA Compliance

It’s no mystery that both companies and consumers benefit from the gig-economy, but what about the workers? Sure, it provides a means to an end, but workers are still missing a major component of employment — benefits.

With states beginning to loosen business closures, more Americans are going to turn to gig-employment as a way of making ends meet. According to an article by the Harvard Business Review, “Today’s gig economy sprung from the last recession, and these gig work platforms — which offered a job to anyone who wanted one — emerged as a lifeline for many facing financial instability.”

As a result of COVID-19, the current unemployment rate is hovering around 11.1%. Roughly 48 million Americans have filed for unemployment and related insurance and although the CARES act has allowed gig-economy workers to qualify for unemployment and benefits, they end July 31, 2020.

The question is, with more Americans turning to the gig-economy for work, when will they receive long-term benefits? It may be sooner than you think.

Already, ridesharing giants Uber and Lyft have promoted a ballot measure called the “App-Based Driver Protection Act” (Driver Act) which reclassifies workers as independent contractors with pseudo-employee benefits. One of the more prominent benefits provided to these new quasi employees under the act would be a “healthcare subsidy consistent with the average contributions required under the Affordable Care Act (ACA).” While not exactly what drivers are fighting for, it’s progress and a step in the right direction for providing gig workers with essential benefits.

Individual states too are taking measures into their own hands to ensure gig-employees are protected.

In Virginia, House Bill 984 was passed earlier this month which adopts the IRS guidelines for distinguishing independent contractors and employees. The bill presumes that all workers that provide a service in exchange for compensation are considered employees and essentially lays the foundation for employers to provide independent contractors and gig-economy workers alike with benefits.

California and New Jersey have similar laws but distinguish employees and independent contractors by conducting an ABC test. Under the ABC test a workers employment classification is determined under three criteria:

(A) The person is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact.
(B) The person performs work that is outside the usual course of the hiring entity’s business.
(C) The person is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.

While the IRS guidelines conduct a different test than California and New Jersey for determining independent contractor status, it is unclear how the IRS will be able to differentiate between the state and federal standards with respect to ACA reporting.

For workers that are reclassified as employees, employers should account for tracking hours of services, wages, and other employee level details for ACA compliance and reporting purposes, as required by the Employer Shared Responsibility Provisions, also known as the Employer Mandate.

Under the ACA Employer Mandate, organizations with 50 or more full-time employees and full-time equivalent employees are required to offer Minimum Essential Coverage (MEC) to at least 95% of their full-time workforce (and their dependents) whereby such coverage meets Minimum Value (MV) and is Affordable for the employee or be subject to Internal Revenue Code (IRC) Section 4980H penalties. The healthcare law defines full-time employees as workers who average 30 hours of work a week or 130 hours a month.

Employers, the responsibility falls on your shoulders for ensuring you are complying with state and federal legislation in regards to employment classification. With more legislation coming into play for providing independent contractors and gig-economy workers with benefits, now more than ever does your ACA compliance process need to be tight-nit.

Now is the time to assess your workforce and incorporate any potentially newly classified employees into their ACA compliance process. Employers will need to extend offers of health insurance coverage to more employees, and reporting requirements will grow in complexity.

There Are At Least One Dozen Possible Candidates For the Bears’ Defensive Coordinator Gig (Let’s Meet Some!)

The Chicago Bears are looking for a new defensive coordinator — again.

For the second time in three years, Head Coach Matt Nagy is looking for a top dog on the other side of the ball. Much like last time around, the Bears’ DC gig should be viewed as a plum opportunity for some enterprising coach. Perhaps it is an assistant on the rise. Maybe it is an experienced coordinator who has been out of the game. It’s possible the right fit is a defensive coordinator with previous head-coaching experience, as to essentially serve as the defense’s head coach and allow Nagy to focus in on fixing that broken offense of his.

All in all, there should be no shortage of candidates who are intrigued by this position. And while Nagy’s long-term uncertain future could scare some away (he’s got just two years left on his deal), coaching Chicago’s defense is still a unique opportunity that someone will want to take.

Kevin Fishbain and Adam Jahns (The Athletic), JJ Stankevitz (NBC Sports Chicago), and Chris Emma (670 The Score) are among those who rounded up candidates. Let’s sort through the most intriguing options.

Internal Candidates

Jay Rodgers, Bears Defensive Line Coach — Rodgers has done a remarkable job building the Bears’ defensive line into a strength since arriving with John Fox in 2015. Should Chicago choose to stay with an internal candidate, Rodgers makes sense as a favorite. His coaching résumé and football life makes Rodgers all the more intriguing. Rodgers was a college quarterback and Indiana and Missouri State, has experience coaching quarterbacks (Missouri State) and receivers (Iowa State) before settling into being a defensive assistant starting with the Broncos in 2011.

Sean Desai, Bears Safeties Coach — Desai is the longest-tenured Bears defensive coach. Which, yes, means he worked for Marc Trestman as a quality control assistant in 2013-14. Surviving the Trestman and John Fox eras means you’re doing something right as a coach … right? Desai has dabbled in all sorts of different football gigs. He coached defense and special teams at Temple (20016-10), running backs at Boston College (2012), and was the Miami Hurricanes’ Assistant Director of Football Operations. Maybe it’s just my preferences showing, but I love when assistant coaches have a variety of experiences rather than a specialization in just one area. It shows the potential for depth and perspective needed to handle bigger roles.

Speaking of which, Desai has been pegged as a young coach to watch as a future head-coaching candidate. So maybe the Bears could see Desai as a Brandon Staley type and choose to promote him with that in mind.

Others: Mark DeLeone (ILBs Coach), Ted Monachino (OLBs Coach), Deshaea Townsend (Secondary Coach)

One-Time Head Coach Candidates

George Edwards, Cowboys Senior Defensive Assistant The Bears interviewed Edwards for their head-coach opening after firing Fox. Unlike in 2018 when concerns were raised about Edwards’ ability to build an offensive staff, the Bears wouldn’t need to bother with that if they were hiring him just as a DC. Edwards’ defenses have been pretty good over the years and deserves plenty of praise for his work as a coordinator.

Teryl Austin, Steelers DBs/Senior Defensive Assistant — Austin was an under-the-radar head-coaching candidate as recently as a few years ago. He even interviewed for the Lions opening that ultimately went to Matt Patricia, which has since sent him elsewhere in the league. The Bengals hired Austin after failing to poach Vic Fangio from the Bears in 2018. After that, he landed on his feet with the Steelers. It could be time for him to make the step up again.

Actual Former Head Coaches

Wade Phillips, Rams Defensive Coordinator (2019) — Phillips took the 2020 season off after being dismissed by the Rams and replaced by Brandon Staley. But it sounds like the well-traveled, long-time defensive coach is ready to get back in the game:

In addition to having a large personality, previous head-coaching experience, and loads of success as a defensive play-caller, Phillips has an active and engaging Twitter account. Put it all together and we have my favorite potential defensive coordinator candidate. It’s probably a long shot, but adding a de-facto head coach with defensive coordinator experience makes sense. After all, it’s exactly what Nagy did when he hired Chuck Pagano. That was a solid line of thinking then, and could be again.

Raheem Morris, Falcons Interim Head Coach — Did you read what I wrote about Phillips? Good. Because everything I wrote him can essentially be applied to Morris. But with Morris, the Bears could hire a younger coach who actually had his hands in the game THIS SEASON. Morris did a bang-up job as the Falcons’ interim head coach in 2020. So much so, he should be a popular candidate for head coach and coordinator positions for his efforts.

Intriguing Assistants

Aaron Glenn, Saints DBs Coach — We all know how much GM Ryan Pace loves the Saints. With that in mind, I wouldn’t be surprised if Glenn lands on the Bears’ wish list. Glenn will likely attract interest from teams with more stable positions. But as JJ Stankevitz points out, Chicago could pitch him on this being a spring-board opportunity to bigger and better things.

Joe Berry, Rams LBs/Assistant Head Coach — Barry has previous defensive coordinator experience with the Lions (2007-08) and in Washington (2015-16). And having picked up experience under Wade Phillips and Brandon Staley in recent years during his stint with the Rams probably helps. Perhaps the third time is a charm?

Previously Connected

James Bettcher, Cardinals/Giants DC — Like Phillips, Bettcher took the 2020 season off. But taking a year away from the game has allowed him time to re-work his scheme, see what’s working elsewhere, and position himself for a bounce-back. Perhaps that opportunity is with the Bears. For what it’s worth, Bettcher was an interested candidate in 2018 before Vic Fangio returned to Chicago. Depending on how things shake out elsewhere, he might be considered a favorite again.

Spike Lee says kids are ready for historic Golden Globes gig

Visionary filmmaker Spike Lee needed an actor of “mythic” proportions to portray a legendary squad leader in his acclaimed Vietnam War drama“Da 5 Bloods.” And late screen icon Chadwick Boseman had just that talent.

“When you have a great actor like Chadwick Boseman to play a mythical character, Stormin’ Norman, and he’s already played Jackie Robinson, James Brown, Thurgood Marshall, Black Panther — the minute [the audience sees] him, they’re in!” Spike told The Times.

“There’s no question that Stormin’ Norman [is] mythical. Because I’m looking at James Brown, Jackie Robinson, Thurgood and Black Panther! So they’re in from the jump — from the get-go,” the Oscar winner said of Boseman’s role in the 2020 Netflix film. “I’m not saying that diminishes his craft, but I’m talking about the total package.”

The pioneering director credits gifted collaborators like Boseman, who died in August, with propelling him and his many seminal works to accolades such as the 2021 American Cinematheque Award. Spike will receive the prestigious honor Thursday in a virtual ceremony celebrating his trailblazing career.

Entertainment luminaries set to honor him include actresses Angela Bassett, Jodie Foster and Rosie Perez and “Black Panther” director Ryan Coogler as well as “Da 5 Bloods” stars Jonathan Majors, Clarke Peters, Norm Lewis, Isiah Whitlock Jr. and Delroy Lindo.

“It’s a blessing,” Spike said of the ceremony’s star-studded lineup. “We’re in a quarantine, so the people who participated could have easily said, ‘Look, it’s a pandemic. I’m Zoomed out.’ And I believe I’m Zoomed out myself. So I’m just blessed and thankful for the people who are participating in this.”

Tickets are still available to stream the American Cinematheque’s prerecorded tribute, which caps what has already been a banner week for the Lee family: On Tuesday, the director’s children with producer Tonya Lewis Lee became the first two siblings of color to be appointed Golden Globe Ambassadors. And their son, Jackson Lee, holds the additional distinction of serving as the Globes’ first Black male ambassador.

Video calling from “the people’s republic of Brooklyn, New York,” Spike spoke with The Times about his kids’ historic achievement and mounting Oscar buzz for “Da 5 Bloods.” (After years of controversial snubs, Spike won his first competitive Academy Award in 2019 for cowriting “BlacKkKlansman.”)

How does it feel to be receiving this prestigious honor at this point in your career?

What this award is, it’s acknowledgement of the people who I’ve worked with — the great artists in front of and behind the camera. Because this film thing is a team, and if people are not working together for one goal, you’re not gonna be successful. And one thing I really always try to have is to have peace and love on my sets, where a diverse group of people — a diverse group of artists — come together to make magic. I’m in my third or fourth decade — I get the numbers mixed up — of doing that. And I think this award is the acknowledgment of the artists who helped me make these Spike Lee joints over many decades.

Your children made history this week as the 2021 Golden Globe Ambassadors. How did you react when you heard they were selected?

I was elated that my son, Jackson, and my daughter, Satchel, were named Golden Globe Ambassadors. And all credit goes to my queen, Tonya Lewis, my wife for the development of our children. I had never heard of Golden Globe Ambassadors and then I had never heard this is the first time the Golden Globes was having [sibling] ambassadors of color either. So, I guess, better late than never — and it’s an honor that it’s Satchel and Jackson.

I’m just gonna give them a hug. I think they got it. They’ve grown up in the spotlight — which could be good and bad, I might add. And I think that other people in this industry could say the same thing. But I think that they can handle it.

‘Da 5 Bloods’ is already getting a lot of Oscar buzz. How does it feel to see your latest work championed by so many heading into the 2021 awards season?

Let’s be honest. Over the years — over the decades — it’s been a complex relationship between myself and the Academy of Motion Picture Arts and Sciences. But I think that over the years, the academy has made a great effort to diversify the voters and have the voters — the membership voters — … look [more] like America. So I take it as an honor, and I also think that, again, it’s an acknowledgement … of the team of actors in front of the camera and the team behind the camera, who contributed to the final film.

One of ‘Da 5 Bloods’ cast members who has drawn widespread acclaim for his performance is Chadwick Boseman. What comes to mind when you think of working with him on that film?

It was a blessing. … And before you ask me: Ryan Coogler, who directed him in “Black Panther,” George C. Wolfe, who directed him in [“Ma Rainey’s Black Bottom”], and myself — none of us knew [he was battling colon cancer]. Our brother did not tell us. He did not tell us, and we all understand why. Because we all know that we would have made exceptions for him.

For example … the first battle sequence [in “Da 5 Bloods”], Chadwick had to run 100 yards. And I told him, “You gotta run like Usain Bolt.” And he had equipment on his back, and it was hot AF. And even with that, he outran everybody. He did not want me to say, “Chadwick, all right. That’s one take. We got it,” or, “Chadwick, don’t run as hard as you can.” He did not want to be treated differently than any of the actors. That is why he made the choice to keep his condition private, and I respect it.
